- Description: The agency says Utah's gambling laws are preempted, days after the state sued Kalshi and Susquehanna over event contracts.

The Commodity Futures Trading Commission has taken Utah to federal court, escalating a dispute that opened last week when the state sued Kalshi. The agency's complaint, filed Oct. 26 in the U.S. District Court for the District of Utah, names the state and Attorney General Derek Brown and asks a judge to stop Utah from enforcing its laws against CFTC-registered prediction markets. Utah is the tenth state the agency has taken to court over the issue.

"Utah seeks to shut down prediction markets across a wide variety of markets," CFTC Chairman Michael S. Selig [said in the agency's announcement](https://www.cftc.gov/PressRoom/PressReleases/9315-26?ref=prediction-daily.ghost.io) on Tuesday. He added that Congress made the CFTC the federal regulator with sole responsibility for overseeing these markets, and that the agency has the expertise and responsibility to defend its exclusive jurisdiction over commodity derivatives. The release argues that Utah's state-court actions get in the way of Congress's decision to preempt state law.

According to RG, the complaint brings a single claim under the Supremacy Clause and argues that federal law preempts Utah's gambling and public-nuisance statutes as applied to event contracts traded on CFTC-regulated exchanges. It seeks a declaration to that effect, along with preliminary and permanent injunctions. Kalshi is not a party to the federal case. Utah's own case, filed Oct. 20 in Salt Lake County, targets Kalshi and Susquehanna International Group. Brown has said Kalshi runs an online casino and calls it a prediction market, and Utah has estimated that unlawful fees on Utah-linked trades reached $30.6 million to $61.2 million through Oct. 19, crypto.news reported.

The backdrop has not favored Kalshi in Utah. U.S. District Judge Robert Shelby granted the state summary judgment in August, and the Tenth Circuit Court of Appeals denied Kalshi's request to block enforcement while it appeals on Sept. 8\. Nationally, the courts are split. The Third Circuit ruled for Kalshi in April, while the Ninth Circuit ruled against it in August and the Sixth Circuit followed on Sept. 25, DeFi Rate reported. New Jersey has asked the U.S. Supreme Court to review the Third Circuit decision, and the justices have not agreed to take it up. The CFTC says it has also filed briefs in four federal appeals courts and one state supreme court.

The next test is whether a federal court treats a suit brought by the agency differently from the challenges Kalshi has brought on its own. A quick ruling on a preliminary injunction could shape how aggressively the CFTC pursues the same strategy elsewhere.

## Guardrails And Gavels

This week's news ran on two tracks. In court, the CFTC took its jurisdiction argument to a tenth state. Outside it, exchanges and leagues kept building the machinery of oversight: integrity agreements, age limits and surveillance teams. Both tracks pursue the same prize, which is durable legitimacy for event contracts.

**Activity:** The NBA signed a memorandum of understanding with the CFTC and named Kalshi and Polymarket preferred exchanges. Kalshi added a $2,500 monthly deposit cap for users aged 18 to 20, and Polymarket said it has investigated dozens of election-related bets.

**Drivers:** The Nov. 3 midterms raise the stakes on insider trading and manipulation. Leagues such as the NFL are pressing for tougher rules, while states keep arguing that sports and election contracts are gambling. Each side wants a record it can point to in court.

**Insight:** Safeguards are doing legal work as well as reputational work. An exchange that can show age limits, surveillance and league cooperation has a stronger answer to the charge that it is an unregulated casino. Yet access still narrows state by state, as Polymarket's halt on new Michigan sports positions shows.

**Our Take:** The industry is learning that winning in federal court is not enough. Regulators, leagues and voters will judge these markets by how they police themselves, especially in the final days before a national election. The CFTC can defend jurisdiction, but only the exchanges can earn trust. Expect more of these safeguards to appear before the next ruling arrives. Credibility is built before the verdict.

## News to Know

The NBA became the third league to sign a CFTC memorandum of understanding, after the NHL and MLB, and named Kalshi and Polymarket its preferred exchanges. Polymarket began blocking Michigan customers from opening new sports positions on Oct. 26, while Kalshi, Robinhood and Coinbase face their own Michigan limits. [DeFi Rate](https://defirate.com/news/polymarket-halts-michigan-sports-positions/?ref=prediction-daily.ghost.io) has the details.

Polymarket's head of investigations says the company has examined dozens of election-related bets, and a source says at least two cases went to the CFTC. [OPB](https://www.opb.org/article/2026/10/27/polymarket-has-investigated-dozens-of-election-cases/?ref=prediction-daily.ghost.io) reports.

Kalshi now caps deposits at $2,500 a month for users aged 18 to 20 and sends alerts when larger balances go heavily into a single trade. [Covers](https://www.covers.com/industry/kalshi-adds-deposit-limits-trading-alerts-for-users-under-21-oct-27-2026?ref=prediction-daily.ghost.io) takes a look.

Polymarket US launched five-minute up-or-down contracts on Bitcoin, Ethereum, Solana and XRP, extending its short-dated crypto menu. [Coinpedia](https://coinpedia.org/news/polymarket-us-launches-5-minute-bitcoin-ethereum-solana-and-xrp-predictions/?ref=prediction-daily.ghost.io) has the scoop.

The week's through-line is a single question asked in two venues: who gets to decide how event contracts operate. Federal lawyers are answering it in the Utah courthouse, while leagues, exchanges and surveillance teams are answering it in policy and product.

Neither answer will settle the matter alone, and each depends on the other. The courts will draw the legal lines, but trust with fans, parents and voters will come from conduct. The market will speak.
