- Description: The state Gaming Commission says Kalshi has refused key document requests on sports contracts, ads and under-21 users.
- Author: Kevin Stott

The New York State Gaming Commission has asked a state court to order Kalshi to comply with investigative subpoenas, opening a new front in the fight over whether sports event contracts are federally regulated derivatives or unlicensed wagers. Represented by the state attorney general's office, the commission filed a verified petition in the Supreme Court of the State of New York, New York County, against Kalshi Inc. and KalshiEX LLC. Gambling Insider and RG reported that the court logged the filing on Oct. 22\. Covers said attorney Daniel Wallach flagged it publicly on Oct. 23.

The subpoenas date to July 31 and were issued under Section 104(7) of the state's Racing, Pari-Mutuel Wagering and Breeding Law, with an Aug. 14 return date. They seek records on sports-event contracts, products offered to users under 21, advertising that describes the products as wagers or bets, and Kalshi's ownership and corporate structure. In the petition, as [RG reported](https://rg.org/news/prediction-markets/ny-gaming-commission-petition-kalshi-subpoenas?ref=prediction-daily.ghost.io), the commission says Kalshi "refuses to comply with key Subpoena requests necessary to assess the scope of Kalshi's operations". The commission says it needs the records to decide whether to seek civil penalties under the Racing Law, and in what amounts.

The petition also restates the state's core theory. It alleges that Kalshi has run a large New York operation for at least 18 months, that state law bars sports wagering without a commission license, and that Kalshi has none. Kalshi has long argued that its event contracts are federally regulated financial products under CFTC oversight, not gambling under state law. Gambling Insider and RG both reported no public response from the company to the petition.

The petition lands amid several overlapping fights. Kalshi sued Gaming Commission officials in federal court in October 2025 after receiving a cease-and-desist letter, and the U.S. District Court for the Southern District of New York denied its request for a preliminary injunction on July 7\. The attorney general's office separately filed a petition dated July 31 asking a Manhattan state court to bar Kalshi from offering sports contracts to New Yorkers, and the CFTC sued New York in April seeking a declaration that federal law gives it exclusive authority over event contracts. As of Oct. 25, no hearing date or ruling on the new petition had been reported.

A court order to produce documents would not settle the preemption question, but it could give the commission the evidence it says it needs to weigh civil penalties. The next signal to watch is whether Kalshi answers the petition on procedure or on federal preemption.

## Oversight Gets Specific

This week's stories share a thread: the argument over prediction markets is moving from principle to paperwork. New York wants Kalshi's records, Kalshi's own filings spell out who may not trade, and rivals in futures are writing to regulators. Abstract preemption fights now run through subpoenas, rulebooks and comment files.

**Activity:** New York's Gaming Commission asked a state court to enforce subpoenas on Kalshi, Kalshi filed admission-rate contracts for 22 colleges with the CFTC, and a commodity trade group urged the agency to withhold approval of Kalshi's perpetual oil contract.

**Drivers:** New Jersey has asked the U.S. Supreme Court to review Kalshi's case, and Covers noted the justices have not agreed to hear it. Until the preemption question is settled, each side is building a record. Regulators want documents, incumbents want conditions on new products, and Kalshi wants to keep listing.

**Insight:** The records fight could matter beyond New York. Subpoena returns, rulebook insider restrictions and regulator comment letters all become evidence about how these contracts work and who trades them. Whoever controls that record may shape the preemption argument as much as any legal brief.

**Our Take:** We think the industry's strongest defense is a paper trail it is willing to show. Kalshi's admissions filings, with their long lists of barred traders, read like a company trying to prove it can police its own markets. Resisting a regulator's document requests cuts against that message. Platforms that want federal protection will eventually have to hand over what states ask for, or explain clearly why they will not. Transparency is the product.

## News to Know

A former CFTC official told the NEXTPredict conference that prediction markets could survive an adverse Supreme Court ruling by adapting, including through state licenses or products beyond sports. [Covers](https://www.covers.com/industry/supreme-court-loss-would-not-sink-prediction-markets-october-23-2026?ref=prediction-daily.ghost.io) has the details.

A trade group whose members include CME Group and ICE Futures US urged the CFTC to withhold approval of Kalshi's proposed perpetual WTI crude oil contract. [Bankless](https://finance.yahoo.com/markets/options/articles/cme-backed-group-pushes-back-175158389.html?ref=prediction-daily.ghost.io) takes a look.

Kalshi and Polymarket, along with their founders, have given at least $5 million to U.S. political groups in the 2026 cycle, and over a third went to state-level groups. [IBTimes UK](https://ibtimes.co.uk/prediction-markets-political-donations-state-battles-1827340?ref=prediction-daily.ghost.io) explains.

Kalshi has filed with the CFTC to list contracts on admission rates at 22 selective colleges, including all eight Ivy League schools, each settled on a school's Common Data Set. [Finance Magnates](https://www.financemagnates.com/forex/kalshi-wants-traders-to-bet-on-how-hard-it-is-to-get-into-harvard/?ref=prediction-daily.ghost.io) reports.

Webull is ending sports event contracts for Connecticut customers, who must close open positions by 11:59 p.m. ET on Oct. 31, as the state's crackdown continues. [RG](https://rg.org/news/prediction-markets/webull-exits-connecticut-sports-prediction-markets?ref=prediction-daily.ghost.io) breaks down the changing landscape.

New York is asking a court for documents, Kalshi is publishing rulebooks that name who may not trade, and incumbents are asking the CFTC for conditions. The fight over prediction markets is being decided less in speeches and more in filings.

That shift favors the side that can document how its markets work. Expect the next round to turn on what gets produced, not what gets claimed. The record is the argument.
